hello. i'm currently hosted here and i want to have my own reselling 'company'. first i have a few questions:

 

1. when u mean 'company', are there any legal papers that i have to fill out? do i have to submit to the business bureau my business plan, etc? how about taxes?

 

sorry if it sounds ridiculous. just wanted to ask first. thanks.

To get a reseller account,

just open a help ticket and ask to be upgraded to a reseller account.

 

Or if you are getting a new domain name for your reller account then ask them to start a new reseller account with the new domain name.

 

Later you can ask them to move your current account into your reseller account.

Don't forget to change its package (plan) to one of your own after.

 

As to the other part, legal papers, thats between you and your local county government.

I'm sure that's there some form you'd need to fill out. It could be as a simple as filing a DBA ("doing business as") just to register a name for your company, but there could be others, depending on what kind of company you want to set up and where you live.

 

Many jurisdictions freely provide information to new small business owners to educate them on the law, forms, taxes, etc., so it might be worthwhile to check with your local government offices (or their web sites) and see what they have.

For the DBA

see the clerks office of your county court house.

Just fill out some basic info:

 

name of company

general discription of what it will do

and $10-15 bucks

is all thats needed in my state.

 

Mine is good for 5 years.

Again, it depends on where you live (and thus what the law is). In California, that statement is not true.

check with your local county court house clerk.

 

getting a DBA won't hurt and they will give your a packet of info that may help.

As others have said, it all depends on the laws where you live. There are several potential issues including DBA (doing business as), corporation papers (good to limit your liability in some cases), taxes (always gotta pay the piper), zoning laws, etc.

 

For the zoning, even running your business out of your home would require checking into zoning laws where I live because, just for an example, to run a business from my home requires the county to approve it. That requires me to pay a fee, post notices on my property that I'm planning to do this so all the neighbors can say "We don't want that", go to a hearing which hopefully none of those neighbors show up to, take an ad out in the paper expressing my intentions, and paying fees and taxes.

 

I don't want to scare you away and most of it is formality but you really need to go to the government and get their opinion (law) on it instead of listening to friends - they always get me in trouble because as good as they intend the information to be and as much as they want to help me, they always end up getting it wrong. :)

My opinion is just keep quiet and do what you want. If your selling some space to a few friends, and regulators consider that a 'business', well then they will next be going after anybody who sells a few good's on Ebay from their home. Do you need a business license to sell you accumulated garage junk, or Grandma's estate?

 

To me, if what you do requires IRS reporting, then you better be a legal business.

Remember, you are offering a service and not having visitors so you might not have to do much at all. I would still check with your local department of economic security. If I were to do that here in Arizona I would not need a license as services here are not taxable. You will have to check on your own though to see what your city and state say.
